Maghera Driver Banned 18 Months After Failing Breath Tests
Alicea Brennan, 55, from Doneysheil Road in Rasharkin, received an 18-month driving ban at Magherafelt Magistrates Court. The court fined her £800 for failing to provide a preliminary breath specimen, driving unfit and without due care. She has 26 weeks to pay the fines.
Police responded to a report of a possible drink-driver on Coleraine Road in Maghera on June 5, 2024. An officer observed a car matching the description swerving across white lines and braking abruptly. The vehicle stopped after blue lights and sirens activated.
The officer noted an odour of intoxicating liquor from Brennan. She had a penny in her mouth and failed to provide a breath specimen after multiple requests, despite instructions. Police described her as unsteady on her feet and irate during arrest. She was taken to Coleraine police station.
At the station, another officer requested a breath specimen four times. Brennan did not provide sufficient air for a reading. She did not mention any medical condition to that officer.
Brennan stated she had driven lawfully after eating pizza and playing pool with a friend. She pulled into a lay-by outside the 30mph limit upon seeing police lights. She denied swerving but acknowledged possible abrupt braking.
Brennan said she tried to provide a breath sample but has a nasal condition. She reported one glass of wine consumed. Deputy District Judge Noel Dunlop ruled she obstructed police.
