Judicial Review Challenges PPS Decision Not to Prosecute RUC Officers in 1992 Shooting
Teresa Jordan, mother of Pearse Jordan, pursues a judicial review to overturn the Public Prosecution Service decision against prosecuting two former RUC officers for perjury. The case relates to the 1992 shooting of her 22-year-old son on the Falls Road in west Belfast.
Pearse Jordan died after an RUC officer shot him as he ran from a stolen car in November 1992. A 2016 inquest found Officers M and Q gave untruthful evidence and suspected they altered a logbook. Coroner Mr Justice Horner referred them to the Director of Public Prosecutions.
In 2024 the PPS ruled no prosecution due to insufficient evidence for conviction. Jordan's counsel Karen Quinlivan KC told senior judges the decision violated human rights under Article 2 of the European Convention on Human Rights and breached PPS prosecutorial code.
Quinlivan stated the PPS erred by not interviewing Officers M and Q under caution. She pointed to evidence from multiple credible sources supporting prosecution. The three-judge panel hears the case, set to continue next week.
Fearghal Shiels, solicitor for Mrs Jordan at Madden and Finucane, said outside court the PPS took eight years for the decision, failed to review all evidence, and neglected to question the officers under caution.
