Dungannon man granted bail after alleged threats to kill and assault
A 36-year-old Dungannon man has been released on bail after appearing in Enniskillen Magistrates Court on charges including threats to kill and assault.
Bernard Christopher Cawley of Oaks Grove, Dungannon, is accused of threatening to kill another male, assaulting him, and using threatening and abusive behaviour.
A prosecutor told the court that police received a 999 call about the defendant's behaviour. The court heard that the defendant was picking up objects and throwing them around the house and shouting at another male in the house.
The alleged victim told police the defendant was drinking and taking drugs. It was alleged that the defendant pushed the other male through the house, held a glass ash tray over his head, and told him he would smash his brains out. The defendant also allegedly said that if the victim called the police, he would kill him.
The accused was arrested and brought to Dungannon police station. The court was told there had been five previous breaches of restraining orders to stay away from the male allegedly assaulted, and the latest order had been lifted a few weeks ago.
The police did not oppose bail. A defence barrister said a key reason for agreeing bail was that the accused and the injured party had a mutual bereavement, an uncle who had recently died.
Judge Alana McSorley noted the defendant had a suspended jail sentence on another matter and if he breached it, he would be jailed. She said she was giving the defendant a chance.
The defendant must have no direct or indirect contact with the injured party, must stay out of the Dungannon area, and is prohibited from alcohol and drugs. He must submit to an alcohol test when asked by police.
He was released on his own bond of £250 and the case was adjourned to November 4.
