Lurgan Filling Station Fined Over Food Safety Violations
The owner of Mace Filling Station on Portadown Road in Lurgan pleaded guilty to six food safety charges at Craigavon Magistrates Court. Ernie Magowan faced offences spanning December 1, 2020, to June 3, 2025.
On June 3, 2025, the business offered three packets of Pinkerton Bacon, one packet of Galtee Ham, and one BBQ Chicken Wrap for sale despite the food being unsafe. Sandwiches, wraps, and coleslaw sat at temperatures above 8 degrees Celsius, conditions that could foster harmful micro-organisms or toxins. Cooked hot dogs displayed for sale registered below 63 degrees Celsius.
The charges also covered failure to implement Hazard Analysis and Critical Control Point procedures. Food handlers lacked sufficient supervision and training in hygiene practices. The business did not maintain records showing a proper food safety culture, breaching 2006 EC Food Regulations.
Craigavon court fined the first unsafe food charge £300. Each of the other five charges drew a £150 fine. Additional costs included a £30 summons fee, £15 offender levy, and £200 counsel costs, totalling more than £1,000.
District Judge Michael Ranaghan noted improvements in hygiene practices after council checks raised the rating from one to four. Magowan confirmed plans to install a sink in the food preparation area. The judge stressed the court's role in public protection while recognising the business's clean record and 12 employees.
Armagh City, Banbridge and Craigavon Borough Council environmental health officers brought the case. A council spokesperson stated officers inspect food businesses regularly and pursue prosecution when needed after guidance fails. Food businesses must register with the department.
