Tyrone Man Fined Over Excess Breath Alcohol in Castlecaulfield
District Judge Francis Rafferty fined James Bell of Moygashel Park, Moygashel, County Tyrone, £300 and a £15 offender levy for driving with excess alcohol in breath on Main Street, Castlecaulfield, January 30.
Police received a call at about 7.05pm reporting a vehicle driven erratically near Lisnamonaghan Road. Officers found the car parked on Main Street, Castlecaulfield.
Bell stood outside a nearby premises when police detected an odour of alcohol. His breath test measured 96 microgrammes per 100 millilitres of breath. The legal limit stands at 35 microgrammes.
Bell provided a statement on January 31. He said he finished work in Cookstown and consumed five or six pints of beer before moving his car from a church entrance.
Judge Rafferty pointed to differences between the prosecution account and Bell's statement. Bell made no reference to erratic driving.
