Age Discrimination Claim Struck Out for Non-Pursuit
An employment tribunal has struck out an age discrimination claim brought by a woman against several public bodies in Northern Ireland.
The case, reference number 40686/22IT, was dismissed on 16 October 2025 by Employment Judge Kelly because the claimant, Lorna Armstrong, had not actively pursued it. The judgment was issued to the parties on 28 October 2026.
The respondents in the case were the Western Health and Social Care Trust, the Department of Finance, the Department of Health, and the HSC Pension Service. The claim was lodged under the jurisdiction of discrimination on the grounds of age.
No details of the original complaint were given in the judgment, which simply stated the claim was struck out for non-pursuit. Tribunal rules allow a claim to be struck out if a claimant fails to actively pursue it, for example by not responding to correspondence or not attending hearings.
The strike out decision means the case will not proceed to a full hearing, and no findings were made on the merits of the discrimination allegation.
