Charity Tribunal Refuses Permission to Appeal Strike-Out
The Charity Tribunal for Northern Ireland has refused an application by Marguerite O'Reilly, on behalf of Gut Health Matters Limited, for permission to appeal a decision striking out her case for non-compliance with tribunal directions. The application was also refused for being out of time.
The tribunal's president, Damien McMahon, said the tribunal has no jurisdiction to grant permission because the appellant did not file within the 28-day limit required by the Charity Tribunal Rules (Northern Ireland) 2010. The parties were notified of the right to appeal on 28 May 2026, giving them until 25 June 2026 to seek permission. No application was received within that period.
McMahon also ruled that the tribunal has no power to extend time for a late application for permission to appeal. He said the appellant may apply directly to the High Court if she wishes, and should provide the relevant decisions and correspondence.
The original appeal was struck out on 19 May 2026 for failing to comply with judicial directions issued on two occasions. The decision to strike out was communicated to the parties on 28 May 2026.
The tribunal president strongly encouraged the appellant to seek advice from a person or organisation experienced in charity law in Northern Ireland. The decision was issued in chambers on 29 October 2026.
