A 25-year-old man from Omagh has been ordered to stay out of Enniskillen as part of revised bail conditions following contested applications at Enniskillen Magistrates' Court on Monday.

Pearse Kelly, of Castleview Park, Omagh, is charged with non-fatal strangulation and assault occasioning actual bodily harm. He denies the charges.

The prosecution alleged that Kelly pulled a woman's hair, kicked her in the head and strangled her. It was further alleged that the woman locked herself in a bathroom and contacted police before Kelly left the scene in a car.

Kelly had applied to have his electronic tag removed and a driving restriction lifted. His defence said he needs to collect his two children, aged five and one, three times a week, and drive for work. The defence also said his mother, who is registered disabled, had been collecting his children and taking him to counselling in Omagh, placing a significant burden on her.

The prosecution opposed the applications, stressing the seriousness of the alleged violence. An investigating police officer gave evidence opposing the changes and said allowing them could affect the confidence of the alleged victim.

The judge described the case as a domestic abuse situation and said it highlighted the need to tackle violence against women and girls. He said that if he had dealt with the original bail application he would have refused bail. He rejected the argument about the curfew, describing it as 'utter nonsense'.

The judge stressed the seriousness of strangulation offences, noting that people could suffer strokes many years later, up to 15 years after being strangled.

The defence had argued that preventing Kelly from entering Enniskillen would provide greater protection to the woman than the driving restriction, and asked the judge to prioritise the driving restriction if he was not prepared to grant both applications.

After the investigating officer indicated that an exclusion zone would be suitable, the judge varied the bail conditions. Kelly was ordered not to enter within a five-mile radius of Enniskillen and was required to sign his bail again.

The case was adjourned until October 26 for an update, with November 30 listed for completion of the full prosecution file.
