Man sentenced for assault captured on CCTV at Dungannon filling station
A Dungannon man has been sentenced for an assault that took place at a filling station on Ballygawley Road.
James Khan, 28, of Springdale, was convicted of assault causing actual bodily harm on October 28 last year.
The court heard the assault was captured on CCTV. Prosecuting counsel told the court the victim had his eyes gouged and testicles squeezed during the incident.
Khan was arrested after police received a report of the assault. He made no comment in response to most questions during interview.
District Judge Francis Rafferty warned Khan that any further assault in the next three years would result in a prison sentence.
Khan was ordered to pay £400 compensation to the victim. A restraining order was also imposed preventing contact with the victim.
Khan was fined £150 plus a £15 offender levy and disqualified from driving for six months for driving without insurance. He received a further £50 fine for having no driving licence.
Defence counsel said Khan had behaved disgracefully and offered sincere apologies to the victim. The court was told the incident followed family court proceedings and that Khan is a full-time carer.
